Pending Home Sales Rise, Beat Expectations - Archibald Relocation

The National Association of Realtors said on Thursday its Pending Home Sales Index, based on contracts signed in October, gained 5.2 percent to 104.8.

Economists polled by Reuters had expected signed contracts, which usually become sales after a month or two, to rise 0.8 percent last month.

The housing market is steadily healing after collapsing in 2006, supported by modest job gains, increased job security and record low mortgage rates. The broader economy has been constrained by concerns the government?s plans to slash the budget deficit next year could trigger a recession. This has hit business confidence, although consumer sentiment has nevertheless improved since the summer.

?We?ve had very good housing affordability conditions for quite some time, but we?re seeing more impact now from steady job creation,? said NAR chief economist Lawrence Yun.

Yun said the data showed some impact from superstorm Sandy, a deadly storm that slammed into the U.S. East Coast in late October.

Rihanna and Chris Brown, Reunited? A Look inside Domestic ...

Ahhh, young love?unfaltering, unadulterated bliss. That breath-taking, knee-buckling, I-can?t-wait-to-get-home-and-talk-to-you-all-night-because-you-are-my-everything kind of feeling you get every time that special someone comes to mind. From the never-ending butterflies you get every time you?re together to the text messages and tweets and smiley faces and LOLs; from those I-want-to-tattoo-your-name-across-my-heart-because-you-are-the-only-one-for-me moments to the late night into the wee hours of the morning phone calls, whispering?and most times breathing?sweet nothings into each other?s ear. The promises made to always be true to each other, the special pact made to never, ever, let anyone (or anything) ever come between you.

What happens when love turns on you? When it bites you and spits on you and punches you and blackens your eyes? What happens when you find yourself lying to everyone?including yourself, about what it (love) has done to you? When you start to blame yourself and make excuses for its abuse? What happens when, bit-by-bit, you start to lose pieces of who you are, and no longer recognize who you?ve become? What happens when love suffocates you with its jealousy and its controlling, possessive ways? When love has taken your heart and disrespects you, belittles you, and keeps you doubting yourself? What happens when love threatens to break up with you when you don?t do what it wants or says? What happens when you become a statistic?

Love holds you hostage. It keeps you afraid to tell anyone what is happening to you. It keeps you believing in its lies and broken promises, keeps you trapped in a vicious cycle. The silence, the loss of your voice, becomes your love?s best friend. Its image is everything. To be looked upon as anything other than the cool, well-liked, nice guy who everyone thinks is the greatest thing that has ever happened to you is not what your love wants to see happen. So it manipulates you?with tears, apologies, promises, and special trinkets. It tells you how much you mean to it, how much it needs you. It makes you believe you are the cause of its abuse. And then, just like that, it plants the seeds of self-doubt and guilt. And before long you are right back under its spell, frantically wanting to believe in the illusion. That its love for you has somehow gotten better, stronger. That love will never hurt you again. And, for a while, maybe it does get better. Maybe it (love) never slaps you, or punches you, or threatens you, again. Maybe.

Chris Brown and Rihanna: Unapologetic and Raising Eyebrows
And as many point fingers, waiting with baited breath, the spotlight is on our most public example of this vicious cycle: Chris Brown and Rihanna. The world is watching. And the irony of it all is that it heated up during October, which was Domestic Violence Month. Chris Brown and Rihanna (their relationship and their choices) are once again under the microscope; every move they make is being dissected. Every word spoken is pulled apart. And we, once again, are confronted with the ugly past, the horrible truth, that he beat her. And, whether we want to be or not, we are haunted by the images of what his fists did to her face.

Consequently, amid rumors and speculation that are spreading like a slow-burning fire, there are questions, doubts, and fears that are swirling through the minds of millions watching the public spectacle between the couple unfold. Are they rekindling a ?love affair? that turned ugly and violent in 2009? Was it (the assault) an isolated incident or a pattern of behavior? What will be different between the two of them this time around? Will it only be a matter of time before he beats her again? Is she stupid/crazy for allowing him back in her life? What message(s) is she giving to young impressionable girls who look up to her? And, of course, there is the million-dollar question everyone wants to know: Has Chris Brown really changed?

Belief systems about relationships and love can change. They are both older?he is 23 and she is 24. Hopefully, they are now much wiser than they were three and a half years ago. Still, nothing changes if nothing changes. And, no matter how much he professes to still care about Rihanna?regardless of how apologetic he might be for what he?d done?only time will tell as to whether or not he has truly changed. At 19, he seemed to, for the most part, blame his behavior on his youth, stating that they were young and that no one had taught either of them how to love one another or how to control their emotions or anger. That may be his truth. And it might even be hers.

The hope is that whatever tools Chris Brown might have learned while he engaged in the domestic violence counseling that was part of his sentencing he?s internalized. And that he?s able to manage his emotions and his behaviors in a way that is not destructive to himself or dangerous to Rihanna or any other young woman.

However, anyone can stop behaviors, but that doesn?t mean they?ve actually internalized change. So, in the meantime, many of us will wait?with side-eyed glares, while shaking our heads, hoping that there is no next time. That Chris Brown is genuinely remorseful for what he did and has seen the error of his ways. That he will never, ever, lay a hand on another woman. Hopefully, for her sake, and his, he has truly changed.

Still, in a climate where silence is an abuser?s best friend and domestic violence continues to climb to epidemic proportions, there are a countless number of women who have lost their voices?and their lives?to love; women from all walks of life, who aren?t?nor will they ever be?under a spotlight like Rihanna, with blackened eyes, swollen faces, and broken spirits who live in fear, walking on eggshells, desperately wanting to believe that love is what love does. That love will always love them back; even when it (love) beats them and stalks them and, in most tragic instances, kills them?and leaves their children motherless. And, despite this knowing, many more will still hold on. They will forgive their abusers over and over and take him back. They will gamble with their hearts, clinging onto toxic relationships, and risk losing their dignity, their spirits, many times their children, and their lives?all in the name of love.

Then what? Whatever becomes of their children, the ones who suffer in silence? The ones who witness the abuse first-and-secondhand? Do their precious little daughters eventually become women who accept abuse as a part of relationships and love? Do their sons evolve into men who become abusers themselves? Does he become another Chris Brown? Does she become another Rihanna?

Patterns of Abuse: From Parent to Child to Parent
Brown himself knows all too well the effects of living in a home where domestic violence exists. In 2007, he shared in an interview what his experience was like growing up in a violent home with an abusive stepfather. How he was terrified. How he hated him. How he didn?t want to put a woman through the same thing his stepfather put his mother through. Yet, whether it was an isolated incident or not?despite whatever tears he shed as a child, despite whatever painful memories he has of his mother?s abuse, he still beat Rihanna.

And the tragic reality is that statistics indicate boys who witness family violence are more likely to abuse their partners as adults. And girls who witness their mothers being abused have a higher rate of being abused themselves as adults. So who really benefits by staying in unhealthy, violent/abusive relationships? Surely not the children.

The fact is, children do not have to be abused themselves to be impacted by violence in the home. Such is the case in my new novel, Silent Cry. It?s the story of 14-year-old K?wan Taylor, who suffered through his father?s sporadic outbursts and berating tirades against his mother. Feeling helpless and hopeless, K?wan spent most of his young life burdened with the pressure of believing he had to protect his mother from his father?s abuse, but not knowing how. It is in his silence that he shares insights and relives painful memories of growing up in a home of violence, revealing his anger toward his father that spiraled into a deep hatred that consumed most of his thoughts, and eventually turned tragic.

Although a fictional account of the devastating effects of secondhand abuse, Silent Cry explores how children, particularly boys, are shaped by domestic violence. How it affects their belief systems about women and relationships. How the fear of becoming an abuser themselves is real. Sadly, many?if they do not receive the proper counseling and intervention with trained professionals who understand the dynamics of domestic violence?probably will. And, someone, somewhere, will be beaten about the face and body. Someone?s screams will go unheard. Someone?s tears will fall unchecked. Their bruises will go unnoticed. Their home will become a battlefield. And without remorse, without regard?another life will be taken.

And no matter how many times we try to forget it exists, or make excuses for it, or try to justify it, the painful reality is, there are many K?wans and Chris Browns in the world who have been shaped and molded by violence, who have lived in fear?witnessing men abuse their mothers, who will become men themselves. And the daunting question will always be: Will they, too, become abusers?

With all that is in me, I hope and pray not. Because, fact of the matter is, they do not ever have to be. There is no reason for disrespect. Violence is a choice. It does not happen by chance. It is learned behavior that can be unlearned. It begins with a thought. It is reinforced by a belief. And it continues as a cycle. And if we are to ever stop this destructive, never-ending spin, we must confront belief systems that support male dominance as the norm in relationships with women. We must challenge behaviors that reinforce stereotypes that encourage boys/young men to act aggressively or to use violence as a way to solve problems. We must teach children at an early age non-violent ways in resolving conflicts.

There is no quick fix. Still, adults must learn to take responsibility for their choices in their relationships; to own their behaviors and seek the proper help in addressing unhealthy, destructive ways of being. And, in doing so?hopefully, the K?wans and Chris Browns of the world will know (and understand) that they are never, ever, responsible for what they?ve experienced as children, but they will always be responsible for what they say and do as adults.

Amazon Web Services Drops S3 Storage Service Pricing About 25%

jassyAmazon Web Services (AWS) announced on stage at AWS re:Invent that it has dropped pricing about 25 percent across the board for its S3 storage service. Senior Vice President of Amazon Web Services Andy Jassy said the price drop will go into effect December 1. AWS has dropped prices 23 times since 2006. Jassy attributed the price drops to what he sees as a virtual circle that has emerged as AWS has expanded. More customers leads to more AWS usage, which fuels the need for more infrastructure. As more is added, AWS gets economies of scale in lower infrastructure costs and, as a result, can lower prices. Jassy said the differences between AWS and its competitors come down to margins. The large, enterprise giants such as Oracle, IBM and HP work on high margins. That has been the way they have historically made their revenues. But now the world is different. The new reality is scale and super-thin profit margins. The big technology giants of the past are making up for this lack of capability to scale with “private cloud” solutions that are nothing more than an effort to “cloudwash,” a term that refers to the habit of these big tech providers to put the cloud name on its legacy hardware. AWS still faces steep competition from the likes of Google, which earlier this week lowered its cloud storage costs by 25 percent.

New understanding of X chromosome inactivation

ScienceDaily (Nov. 27, 2012) ? In a paper published in the Nov. 21 issue of Cell, a team led by Mauro Calabrese, a postdoctoral fellow at the University of North Carolina in the lab of Terry Magnuson, chair of the department of genetics and member of the UNC Lineberger Comprehensive Cancer Center, broadens the understanding of how cells regulate silencing of the X chromosome in a process known as X-inactivation.

"This is a classic example of a basic research discovery. X-inactivation is a flagship model for understanding how non-coding RNAs orchestrate large-scale control of gene expression. In the simplest terms, we are trying to understand how cells regulate expression of their genes. Our findings are relevant across the board -- by understanding how normal cells function we can apply that knowledge to similar situations in the understanding and treatment of disease," said Calabrese.

Proper regulation of the X chromosome plays a crucial role in mammalian development. Females inherit a pair of X chromosomes from their parents, and the process of X-inactivation shuts down one of these two Xs.

"Males have XY. Females have two Xs. One of those Xs needs to get shut off. If it does not, it's not compatible with life. It's how we have evolved to equalize doses between males and females," said Calabrese.

While the manner in which the X chromosome is deactivated has been actively studied for 50 years, the exact mechanisms that regulate the process remain a mystery. Calabrese's research used high-throughput sequencing to determine the location and activity of chromosomes with far greater accuracy than previous research.

"Basically, this is using the sequencing technology as a high resolution microscope," said Calabrese.

Under a microscope, the inactive X chromosome (Xi) appears as a cloud-like structure, because it is covered with a non-coding RNA known as Xist. In the traditional model of X-inactivation, genes located inside the cloud are completely silenced, with 15 percent of the genes from the inactive X chromosomes escaping to become active.

"The prevailing thought was that genes that escaped X inactivation were pulled out of the core and expressed out there," said Calabrese.

The work of Calabrese's team complicates the current model of X-inactivation by finding indications of gene activity inside the Xist cloud and the presence of inactive genes outside the cloud, both of which would not have been thought possible in the prevailing model.

"It's kind of a subtle thing, but mechanistically it is a big difference," said Calabrese.

Inside the Xist cloud, sequencing discovered traces of DNase I sensitivity, a feature usually linked to transcription activity. While other markers associated with transcription were absent, the presence of DNase I sensitivity suggested that the nucleus did recognize the inactive X as usable DNA, but an unknown suppressive mechanism was preventing genes from being activated.

"We were surprised to see that. If they were totally silent, you would expect this to be not there? This suggests that transcription factors or other proteins that bind DNA are still accessing the inactive X," said Calabrese.

The other surprising findings involve the 15 percent of "escaper" genes from the inactive X. Calabrese found evidence that active genes were found both inside and outside the Xist cloud, and that silenced genes that lay alongside active genes outside of the Xist cloud remained inactive.

"If X-inactivation was a strict nuclear barrier, then pulling a gene outside the barrier would turn it on, but it has got to be more than that because when an inactivated gene that is beside an escaper is outside this domain, it is still turned off," said Calabrese.

The presence of DNase I sensitivity within the Xist cloud and the finding of inactive genes outside of the cloud suggest that a site-specific mechanism is regulating genes on the chromosome in a more subtle way than the binary "on/off" function posited by the prevailing model. The exact mechanism for this remains unknown. Although Calabrese believes that Xist still plays a role, its exact function and whether other factors influence X-inactivation remain questions for future research.

"We know that Xist is required to turn off the inactive X. We know that. We have no idea how" said Calabrese.

Beyond revising the understanding of how X-inactivation works, Calabrese said that deeper understanding of the function of Xist could reveal more about the role of other non-coding RNAs in cellular development. These RNAs could become useful targets for future therapies and drug development.

"We know that too much expression of the wrong non-coding RNAs can lead to cancer. Also, forced expression of other non-coding RNAs can prevent cancer. Generally, we do not know how these RNAs work," said Calabrese.

Grove Professor Receives $1.5MM to Study Breast Cancer - CUNY

For some time, researchers have known about disparities in diagnoses and outcomes among breast cancer patients based on race and age. However, they have been challenged to develop a set of criteria that can be used to reliably target drug delivery mechanisms based on an individual patient?s tumor.

Dr. Debra Auguste, associate professor of biomedical engineering in the Grove School of Engineering at The City College of New York, will investigate personalized therapies to inhibit breast cancer metastasis supported by the National Institutes of Health Director?s New Innovator Award. The grant, which provides $1.5 million over five years, funds ?exceptionally creative new investigators who propose highly innovative projects that have the potential for unusually high impact.?

?By applying our knowledge and experience in chemical engineering, materials science and nanotechnology, we hope to develop therapeutics that will increase breast cancer patient survival by inhibiting tumor progression and metastasis,? said Professor Auguste, who joined the Grove School faculty in September from the Harvard University School of Engineering and Applied Science.

?Our goal is to use biological information to design new drug delivery vehicles that can target tumors. We have been studying what the cell surface looks like, how proteins relate to one another, how they are organized and what their ratios are.?

The strategy marks a departure from other investigations that have focused on the role of messenger RNA, which is transcribed into proteins. ?People often think if you have a large amount of messenger RNA you have a large amount of protein, but we don?t necessarily know how much protein is being produced,? she said.

Current breast cancer treatments are regulated by cell surface presentation. For example, breast cancer cells that express estrogen receptor and human epidermal growth receptor-2 on their surface are treated with hormone (anti-estrogen or aromatase inhibitors) or targeted therapies such as the monoclonal antibody trastuzamab (Herceptin), respectively.

Professor Auguste plans to develop personalized treatment approaches for four metastatic breast cancer populations: black women, white women, women over 40 and women under 40. Epidemiological studies have found that white women are more likely than black women to be diagnosed with breast cancer, however black women are more likely to die from it. In addition, women under 40 are more prone to aggressive forms of the disease.

She expects to characterize the surface density and proximity of two receptors that govern cell recruitment: CXC chemokine receptor type 4 (CXCR4) and CC chemokine receptor type 7 (CCR7). This information will then be used to synthesize complementary engineered liposomes (CELs) that cooperatively bind CXCR4 and CCR7 and deliver short interfering RNA (siRNA) to knock down lipocalin-2 (Lcn2), which has been shown to induce the epithelial to mesenchymal transition (EMT).

Lipocalins are a family of proteins that transport small, hydrophobic molecules such as steroids, retinoids and lipids. A growing body of evidence points to the EMT playing a role in metastasis of cancers.

Professor Auguste hopes to produce CEL therapies that will enhance cooperative binding to each cell type and reduce cell migration and invasion. Homogeneous and biphasic CELs are designed to complement the relative surface density and organization of receptors on breast cancer cells. They do so by allowing conjugated antibodies to rearrange on the surface or by clustering antibodies within gel-phase lipid domains.

?The binding event is regulated by multiple receptors. We need to understand how multiple proteins work together to engineer adhesion,? she explained. ?If we can understand that, we can hopefully go from a non-adhesive vehicle to one that is adhesive in order to trigger a favorable response. The key is adhesion of the drug delivery vehicle to tumor cells.?

In previous research targeting cytokine-activated endothelial cells, Professor Auguste reported evidence that vehicles that complement the cell surface enhance binding.

Professor Auguste plans to encapsulate cancer drugs inside a lipid shell that will be very similar to a cell membrane and decorate the shell with one or more antibodies arranged in different ratios. She also intends to ?play around? with the molecules? surface mobility and organization. ?We?ll test lots of different engineering parameters in order to achieve optimal efficacy.?

To assess the effect of CEL on cell migration, activation survival and the EMT process, she will conduct mechanistic studies involving the expression of various proteins and enzymes.

Professor Auguste intends to demonstrate similarities and differences among six different breast cancer cell lines and deliver a platform technology designed to address tumor metastasis. The cell lines chosen represent the most metastatic and invasive forms of breast cancer with the poorest prognoses for survival. ?We want to learn what is different about these breast cancers and whether we can develop a better treatment that can more effectively target the tumor and control it,? she said.

NIH established the Director?s New Innovator Award to address two important goals: stimulating highly innovative research and supporting promising new investigators. It differs from traditional NIH grants in that it is designed specifically to support unusually creative new investigators with highly innovative research ideas at an early stage of their career when they may lack the preliminary data required for an R01 grant. In 2012, 51 such awards were granted nationally.

Eight policemen wounded in Russian prison protest

MOSCOW (Reuters) - Eight Russian policemen were injured trying to disperse a crowd outside a prison where 250 inmates staged a roof-top protest demanding the release of a group of fellow prisoners from a punishment cell, authorities said on Sunday.

Russian state television showed pictures of a group of inmates standing on the roof of the prison holding white banners reading "people, help" in the town of Kopeysk near the industrial city of Chelyabinsk in the Urals mountains.

Details of the incident remain unclear with human rights activist Oksana Trufanova telling the Echo Moskvy station that OMON special police troops attacked a group of inmates' relatives outside the prison.

"They beat us with batons. Their eyes were shining. I had never been in such mayhem," Trufanova said. Police said 38 people were detained, but denied OMON officers had beaten people outside the prison.

Trufanova said the protest was a consequence of regular beatings in Kopeysk prison. The local prison authority said in a statement the situation inside the prison was now stable and under control.

Police said the troops were attacked by groups of drunken youths who were throwing bottles and shouting obscenities. Prison mutinies in Russia are relatively rare.

More than 700,000 Russians are currently behind bars and human rights activists regularly complain of poor living conditions, cases of torture, beatings and disease in prisons.

Conditions in Russian prisons came to international attention after Sergei Magnitsky, a lawyer for equity fund Hermitage Capital died a Moscow prison. The Kremlin's own human rights council says he was probably beaten to death.

The local prison authority said the protesters had no demands other than the release of a group of their fellow inmates from a punishment cell. It said the group had violated prison rules and the demand to release them was illegal.

Understanding the difference and classifying an employee or independent contractor correctly is important for Colorado companies to avoid potential liability claims for workers compensation insurance, negligence or other statutory violations.? Determining who is an independent contractor versus an employee can be tricky and should be scrutinized carefully.? Willful misclassification of employees as independent contractors will make your problems even worse.

There are many situations when companies hire independent contractors.? It might be for a construction project, or the need to develop a company website, or even consulting project.? Most of the time these relationships have met the expectations of both parties without legal remedy. ? However, there are times when the relationship is tested and those companies who failed to do the obvious realize a problem has arisen.?

Roofing Company? Sued For The Injury of Subcontractor?s Employee

A roofing company hires a subcontractor to install a roof for a homeowner.? The subcontractor hired an employee and failed to secure workers compensation insurance as required by law.? His first day on the job, the employee falls off the roof and the roofing company was liable for bodily injury damages.? The liability flowed upstream in this case which meant the roofing company had to hire an attorney, prepare for trial, and settle out of court.? A real example meant to illustrate the severity, consequences and necessity by business owners to think carefully through their independent contractor relationships before any work is commenced.

This means having a valid, legal and authentic contract with the independent contractor your planning to hire.? A clear outline of the relationship between both parties to include financial, relationship, and behavioral factors. ? The significance of investing the time and money up front should not be understated.? The goal is to clearly minimize your liability.? Otherwise, the liability of the independent contractor and their employees could become the liability of the company that hired them.???

The Colorado Workers Compensation Act (?Act?)? and Internal Revenue Service? (IRS) provides guidance for Colorado companies who hire independent contractor

The Act is meant to inform Colorado businesses this is how the Centennial State views the components of an independent contractor under a microscope.? In other words, if your going to hire independent contractors your best chance of getting it right is to adopt these statutory provisions.? Your relationship with an independent contractor should look, feel, and smell like this.? If a company decides otherwise and adopts their own contractual framework, it could lead to penalties, litigation and unnecessary business expenses should it become tested. ? ? ?

What are key components of the contract according to the Act? ??

  1. The company must not require the independent contractor to work with them exclusively.? The independent contractor must Employer Liability of Hiring Independent Contractorshave the opportunity to retain and service other customer besides your business.? If you?ve implied or expressed to the independent contractor, they?re exclusive to your company, it might not pass the test.
  2. The company must not mandate or establish certain quality standards for the work.? This means your company should not be telling the independent contractor how something should be done or how it should be performed.?? Your hiring an independent contractor for their expertise.? If you need to direct, mandate or require how something is to be performed?hire an employee.
  3. There should not be a set salary or hourly rate for the independent contractor.? The contract should focus on a contract rate.? For example, paying a website developer upon completion of your company website $X amount.?
  4. A termination clause should specify the contract will terminate when there? s a breach of contract or the work is not meeting certain specifications.??
  5. Any training to the independent contractor should be minimal.? If your company training is extensive, it could cross over to becoming an employer/employee relationship.
  6. Benefits or tools should be supplied by the independent contractor and not the company.? This doesn?t mean equipment or materials can?t be used by the independent contractor.
  7. What time or hours the independent contractor works should not be dictated by the company hiring them.? You may have a time-frame for completing the work by a certain deadline.?
  8. All checks or payment should be paid to the company of the independent contractor and not individually.?
  9. The two entities?company who hires the independent contractor?both should have separate and distinct operations.? Don?t commingle the operations in any way.
The Act specifies a contract should be written, signed and notarized between both parties.? In addition, the contract should state in bold face, underlined and type which is larger defining the independent contractor? is not entitled to workers compensation insurance.? ? Source:? The Internal Revenue Service has identified three categories to help define the relationship between a company and independent contractor.? They are behavioral, financial, and type of relationship between the two parties.? Accordingly, there is no magic formula or ?weighting? used amongst the categories to provide a definitive answer, but is meant to provide guidance for those seeking the best way to structure the relationship to their satisfaction.

Behavioral Factors:

The influence over the independent contractor by the payer is an important factor.? Think of it as control and direction by the company who has engaged the independent contractor and providing a certain amount of direction.? Here are important considerations:

  • Where to do the work or when is the work performed.

  • Who provides the tools and equipment?

  • Are workers hired by the independent contractor?

  • Where to purchase supplies and services.

  • What work must be performed by a specified individual.

  • What order or sequence to follow when performing the work.

Financial Factors:

This includes how the payer as negotiated with the independent contractor to pay them.? Hourly or salary insinuates they?re an employee.? A fixed payment pursuant to the contract is indicative of an independent contractor.

Typically,? financial control factors fall into the categories of:

  • Significant investment by the independent contractor versus the payer

  • Unreimbursed expenses absorbed by the independent contractor

  • Opportunity for profit or loss indicative of a self employed company

  • Services available to the market.? The independent contractor is free to market their services to other companies.

  • Method of payment?salary and hourly is not the preferred method of payment.? A fixed price with a specific outcome if favorable.

Type of Relationship Factors:?

Consider this category based on contractual obligations or benefits offered under a course of employment such as retirement, insurance, and vacation or sick pay.? The type of relationship between two?parties can generally fall into the categories of:

  • Written contracts?documents between both parties clearly stating the obligations, promises, and conditions

  • Employee benefits?does independent contractor pay for the benefits of their employees

  • Permanency of the relationship

  • Services provided as key activity of the business

According to the internal revenue service,? the wording of the contract is not the primary basis for classifying a payee as employee or independent contractor.? This category evaluates the relationship along with how the parties worked together.? This could mean everything outside of the written agreement could be subject to interpretation.? Company emails, verbal promises, or implied actions become relevant.

What?s Important To Know About Workers Compensation Insurance?

Colorado companies must remember independent contractors who fail to provide workers compensation insurance for their employees, it becomes the liability of the company who hired them.? The liability ?flows up? the ladder of hiring organizations.? Part 4, Contractors and Lesses of the Workers Compensation Act specifies a company that leases or contracts out any part of the work to a lessee, sublessee, contractor, or subcontractor?.shall be construed to be an employer and liable to pay compensation for injury or death.? In other words, your company became the employer regardless of the number of employees and subsequently liable.?

What would happen if the company at the top of the ladder doesn?t have their own workers compensation insurance policy?? The situation becomes even more precarious.? The roofing company discussed previously failed to have workers compensation insurance, which would have covered the injured employee.? The outcome of the lawsuit resulted in significant legal expense, loss of income, damage to the company reputation and settlement of over $25,000.

This means companies should consider clause in your contract stating workers compensation insurance is the responsibility of the independent contractor as required by law.? In addition, the company should obtain proof of coverage through a valid certificate of insurance and verify with the insurance carrier the policy is active.? This must be enforced before any work is commenced. ??

What Are The Penalties For Not Purchasing Workers Compensation Insurance?

Colorado will enforce the Workers Compensation Act vigorously and every Colorado company operating without workers compensation should take this warning seriously.?

The discovery for not having a workers compensation insurance policy is a $250/day initial fine for each day you don?t have an active insurance policy.? If you?ve been operating for 365 days without workers compensation the fine could be significant.? The Director may issue a cease and desist order to discontinue operating your business as an additional penalty, until the policy has been purchased.?

The second, third or more offense means the fine goes up to $500/day.?? In addition, in cases where workers compensation has been awarded to an injured worker, benefits will be increased by 50% when the employer failed to obtain workers compensation insurance.

There may be additional penalties for those who willfully classify employees as independent contractors.? Under House Bill 09-1310, the Colorado Department of Labor may impose fines up to $5,000 for the first offense and $25,o00 per employee for subsequent violations.

Mexico elected Pena Nieto, who wants a one-party state (controlled by him) and his vision to create a massive entitlement state in Mexico. Even small Thailand elected a new prime minster Yingluck Shinawatra, their first female head of state. She believes and has implemented government interventionist policies such as price control and minimum wage.?

The common theme with all of these leaders is that their country voted in leaders who want a bigger more intrusive government. When that happens individual freedom is taken away. They are also a reason why there is so much monetary manipulation throughout the world. Fiat currencies all over the world are soon to be going worthless and when that happens, people will turn to what has always been used as money throughout history- gold and silver.

Thai-Inspired Mango Salad | Creative Sides for Lean Cuisine Frozen ...

You know how right before a holiday, you try to eat something completely different than whatever it is you?ll be indulging in on the big day itself?

Or is it just me that does that?

Ahem anyhow. So, back to me?

On Thanksgiving Eve, I was in Sam?s Club scoping out what might be Black Friday get-out-of-bed-worthy, and while I was there, I ?decided to grab an opposite meal.

The opposite of Thanksgiving is Asian.?(According to my rules.)

Soooooo, since Sam?s Club sells frozen meals (and everything else under the sun) in bulk, I obviously went home with Lean Cuisine times more than one. (A 6-pack, to be exact. Score.)

Why Lean Cuisine meals, you might ask?

Three reasons:

I love the way they taste.

They?re healthy and low-calorie, so I can add a side dish and still not feel guilty.

They have a loyalty program, and there are reward points in every box. ;)

Now about that side dish thing?. I could easily have made a simple tossed salad and called it quits.

Pish posh!

I wanted a creative side which would enhance the Asian flavors, so that?s how I ended up making a Thai-Inspired Mango Salad and wow, was it delicious!

?Thai-Inspired Mango Salad

Ingredients

Fresh mixed greens (enough for 2 people)
Green mango (find one that?s very firm, not ripe)
Small red pepper (sliced thin or cubed)
1 cup bean sprouts
1 carrot, grated
1/2 cup cucumbers, sliced
1 pkg fresh basil (about 15 leaves)
3 T freshly squeezed lime juice
2 T Worcestershire sauce
1 T balsamic vinegar
1 T brown sugar
2 tsp Thai roasted red chili paste

Directions

1. Toss mango, red pepper, bean sprouts, and carrot in a salad bowl. Set aside.

2. Using a food processor or blender, pulse together basil, lime juice, Worcestershire sauce, balsamic vinegar, brown sugar and roasted red chili paste to make salad dressing. (If using a blender, it?s better to finely chop the basil before blending.)

3. Add cucumber slices on top.

The salad has both a sweetness and a kick to it, and it was an easy way to take a quick, convenient meal and elevate it to something just a little more special!
